Modernizing International Arbitration: A Framework for Smart Mechanisms beyond the New York Convention Regime

Abstract:

Smart arbitration platforms are transforming international dispute resolution through the incorporation of digital technologies and robot capabilities in arbitration proceedings. These innovations are efficient and transparent, but they also raise serious concerns about fairness, data security, and judicial oversight. The New York Convention remains the core of cross-border enforcement, but its assumptions are those of traditional processes rather than emerging digital practices. The study examines problems generated by the conflict between old Convention rules and the development of technological methods in international arbitration. It covers key issues such as procedural uncertainty, accountability, openness, and the growing impact of algorithmic decision-making. The study exemplifies the various strategies of striking a balance between innovation and legal safeguards by comparing Singapore with the European Union. This essay proposes an alternative legal system that blends smart technology with existing arbitration principles, while preserving fairness and due process. The findings contribute to current debates on the modernization of international arbitration and the adaptation of dispute-resolution methods to technological advances.
